mercer may have thought one of the men stole something from him. and he reached in to the man's pocket tote retrieve it. as -- pocket to retrieve it. the dispute got heated as the men left the store. this is what police had to say in the days after the incident. >> at this point in time, this is not a random assault. we don't believe that this involved a robbery, but there was a dispute betwe the complainant and another individual. >> reporter: he was hit once once in the face and fell backward hitting his head. the man who threw the punch claims to have been defending himself. at mercer's capitol hill home, there was no answer. the next door neighbor said he has not seen the consultant since the attack. here's his health and it's improving. he was not happy to hear the case is closed. >> i am disappointed and have known david for over a decade. he's a brilliant guy and to

drinking establishments, bars and restaurants that will be allowed to stay open throughout the district. it's a sunday to monday and you remember there was a controversy here and they allowed bars to stay open an hour later every weekend but others didn't like that at all and came up with a compromise to allow the bars to stay open. this is the first time it will happen on sunday night. the longer hours will take place sunday night into monday morning. the bars a proved on this list will be authorized to stay open until 4:00 a.m. this is something the council member worries about. >> the key problem is there is no public transporting a. people who want to go drinking until the later hour will driver and they will have to take a taxi.

and so i think the congestion, the noise is likely to increase. maybe not this weekend but as the program expands. >> reporter: he tried to kill the legislation to keep the bars open later. he didn't win that fight but scored a victory by trimming the late hours to holiday weekend instead of all weekend. >> and this first weekend, only 42 got permission. >> there was a concern about safety. early yet morning when the bars let out, an hour later. we talked to chief lanier several times about this and she didn't see any problems at all and that there are officers on the street at 3:00 and 4:00 and did not see a problem with that and man residents who live

like this are concerned because it causes a lot of noise, they say, and the people coming out of the bars are typically loud and keep them up late at night. back to you. >> all right, matt ackland, thank you. four d.c. police officers indicted in a vicious beating were offered plea deals. the announcement made during a status hearing in the case. yolanda lampkin is accused of obstruction of justice and perjury while the other three officers are accused of taking part in the beating or making an arrest after the assault. walter blair and another man were brutally assaulted outside of the lotus night club on k street. a total of nine people were indicted and the trial was scheduled for may. and to prince georges county. sky fox over the scene about 9:00 this morning over 85th avenue and in new carrollton. look at the photo of one of the rescues. crews were able to remove a

degrees in salisbury. right now, 81 and that is real, real good and we're going to be gorgeous at 7:00. nice at 9:00 and the temperature down to around 70 degrees, if not, the upper 60s in the suburbs. 67 degrees at 11:00 and we're talking fair skies. the trend is still much cooler by sunday. and i would not think some of you are thinking it's cold on sunday and not talking much in the way of sunshine. tomorrow, the setup remains the same. a frontal system to the west of us and we'll have some spires ahead of the front and that is not looking like rain. the front will pass and we're talking significantly colder temperatures. again, not only are we talking about colder temperatures, we're talking about clouds and more rain from the south and we're bringing rain in here on

sunday and that is not looking like heavy rain and the temperatures will be dropping through the day andfo 4, 5:00 on sunday afternoon, they may end up having temperatures in the upper 40s in some places. sunday is looking rainy and raw, pretty good tomorrow for most of the day and more in the waif clouds and sun. here we are now, kind of stuck in the middle, a few clouds to the south-southeast. off to the shore here and then back to the north-northwest. more clouds. tomorrow is not going to be as much or sunny as where we have been today. but it still looks like it's going to be nice. overnight tonight, a few clouds. the suburbs are dropping again down into the mid- to upper 50s in town. just lower 60s should do it. the winds out of the southwest at 5 to seven miles an hour. and as we take you through the day tomorrow, i think it's going to be a cool start.
